Version 1.3 · Effective October 2026
This Coaching Agreement and Release ("Agreement") is between Whole Body By Design, LLC ("Whole Body By Design," "I," "me," or "Coach"), and each person signing below ("you" or "Client"). If two adults sign up together, each of you signs and each of you is bound by this Agreement. Please read it carefully. By signing, you confirm you have read, understood and agree to everything in it.
1. What coaching includes
Coaching is a personal health and lifestyle coaching relationship for one adult, two adults coaching together (a "couple plan"), and any children added to either plan. Depending on your program, it may include weekly check-ins, nutrition guidance and planning, exercise programming, habit and lifestyle coaching, educational review of lab results you choose to share, and access to the Client Library. The specific plan is built around you and may change as we learn what works.
2. Coaching is not medical care
I am a health and lifestyle coach. I do not diagnose or treat disease. I am not a physician, registered dietitian, pharmacist or licensed mental health professional, and coaching is not a substitute for medical, dietetic, psychological or other professional care.
- Any discussion of lab results is for education only, to help you ask better questions of your own healthcare providers. It is not a diagnosis or interpretation for medical purposes.
- I will never advise you to stop, start or change a prescribed medication or treatment. Those decisions belong to you and your doctor.
- Any mention of a supplement or product is general education, not a prescription. Check with your doctor or pharmacist before taking anything new, especially if you take medication, are pregnant or breastfeeding, or have a medical condition.
- You agree to keep a relationship with your own physician and other healthcare providers for all medical needs.
3. Your health and safety
You agree to:
- Get clearance from your physician before starting any new exercise or nutrition program, particularly if you have a heart condition, high blood pressure, diabetes, a joint or bone condition, a recent injury or surgery, a history of disordered eating, or are pregnant or postpartum.
- Tell me, truthfully and completely, about any medical conditions, injuries, medications, allergies and pregnancy, and tell me promptly if anything changes.
- Listen to your body. Stop any exercise immediately and seek medical attention if you feel pain, chest pressure, dizziness, faintness, unusual shortness of breath or any other warning sign.
- For any child added to your plan, get clearance from the child's doctor before they start a new exercise or nutrition plan, and tell me about any health conditions, injuries, medications or allergies that affect them.
- Call 911 or go to an emergency room in an emergency. Coaching is not an emergency service.
4. Assumption of risk and release of liability
You understand that exercise and changes to diet, sleep and lifestyle carry risks, including but not limited to muscle soreness, strains, sprains, fractures, falls, cardiovascular events, allergic reactions, digestive upset and, in rare cases, serious injury or death. You voluntarily choose to participate and you knowingly assume all of these risks, whether you exercise or follow guidance alone, at home, at a gym or anywhere else.
To the fullest extent permitted by law, you release, waive and agree not to sue Whole Body By Design, LLC, Elizabeth Bernal, and their owners, employees, contractors and agents from any and all claims, injuries, losses or damages arising out of or related to coaching, exercise programs, nutrition guidance, the Client Library or any other services, including claims based on ordinary negligence. This release does not apply to gross negligence or intentional misconduct.
You agree that the total liability of Whole Body By Design, LLC for any claim related to this Agreement will not exceed the amount you paid for coaching in the three months before the claim arose.
5. No guaranteed results
Everyone's body is different, and results depend on many things outside my control, including your consistency, health history, genetics and circumstances. I will give you my full effort and expertise, but I do not guarantee any specific result, such as weight loss, symptom improvement or changes in lab values. Client stories shared on my website reflect individual experiences, not typical or promised outcomes.
6. Payment and billing
Every plan starts with a 3-month program, paid in full at sign-up, whatever day of the month you start. The program runs for 3 months from your start date, and coaching begins once your payment is received.
- Individual plan: $600 for the first 3 months, then $200 a month.
- Couple plan (two adults coaching together): $1,050 for the first 3 months, then $350 a month.
- Children: children may be added to either plan for $50 a month per child ($150 per child for the first 3 months). You pay for no more than two children; a third child and any after that are included at no extra cost. For children, coaching includes age-appropriate workouts and nutrition planning, including adjusting family meals for picky eaters.
- After your first 3 months, coaching continues month to month at your plan's monthly price until you cancel as described in Section 7. Your first monthly payment is prorated for the rest of that month, and after that payment is due on the 1st of each month. I will send you a payment request each month, and you agree to pay it by the due date. If you later pay by card, you authorize these recurring monthly charges to your card.
- How to pay: by Zelle, Venmo, or cash in person. Card payments may be added later. Please include your name in the payment note so I can match it to your account.
- Changing your plan: adding a partner or a child takes effect from the date we agree, with the price for that month prorated. Removing someone follows the 30-day notice in Section 7.
- Late or failed payments: if a payment is late or does not go through, I will let you know. If it is still unpaid 7 days after it was due, coaching and Client Library access are paused until it is paid.
- Prices may change for future months. I will tell you at least 30 days before any change applies to you.
7. Refunds and cancellation
- The first 3 months are a commitment and are non-refundable, including if you, your partner or a child stops partway through.
- Cancelling takes 30 days' written notice. Any monthly payment that falls due within the 30 days after I receive your notice is still due as normal, and you keep coaching through the end of that paid month. After that, there are no further charges.
- If you do not want to continue after your first 3 months, give notice at least 30 days before your program ends. I will raise this with you at a check-in at least 6 weeks before your program ends, so it never catches you by surprise.
- Payments already made are not refunded, except as described in Section 12.
- To cancel, email elizabeth@wholebodybydesign.com. Your notice date is the day I receive your email, and I will confirm your cancellation and your final day of coaching by email.
- The full Refund & Cancellation Policy is part of this Agreement.
8. Appointments
- With more than 48 hours' notice, an appointment may be rescheduled.
- Cancelling, rescheduling or not showing up within 48 hours of an appointment is not refunded, and the appointment may be forfeited.
- Consistency drives results. If you need to reschedule, it is critical to keep the new appointment within the same week so your progress keeps moving.
- If I need to reschedule, I will give you as much notice as possible and offer another time, and you will not lose the appointment.
9. The Client Library and my materials
All recipes, meal plans, shopping lists, exercise programs, handouts, videos and other materials I provide, including everything in the Client Library, are owned by Whole Body By Design, LLC and protected by copyright. You may use them for your own personal, non-commercial use. You may not share your login, copy, resell, publish or distribute the materials. Library access ends when your coaching ends.
10. Confidentiality and your information
I keep what you share with me confidential, including your food logs, health history and lab results. I will not share it with anyone without your permission, except where required by law (for example, Arizona law requires reporting suspected abuse or neglect of a child) or where I believe there is a serious and imminent risk of harm to you or someone else. Because I am not a healthcare provider, coaching is not covered by HIPAA, but I take reasonable steps to keep your information secure. See the Client Privacy Notice for details.
I will never share your name, photos, story or results publicly without your separate written permission.
11. Communication
Between appointments you can reach me by email. I aim to reply by the next business day. Messages are not monitored around the clock and are not for urgent or emergency matters.
12. Ending coaching
I may end the coaching relationship if I believe coaching is no longer appropriate or safe for you, if you need care outside my scope, or if this Agreement is broken, including through abusive behavior or non-payment. If I end coaching for a reason other than your breach of this Agreement, I will refund any prepaid amount for coaching you have not yet received.
13. Electronic signature
You agree that typing your full legal name and checking the boxes on the sign-up page is your electronic signature, has the same legal effect as a handwritten signature, and that this Agreement may be delivered and stored electronically. You may request a copy at any time by email.
14. General terms
- This Agreement is governed by the laws of the State of Arizona. Any dispute will be handled in the state or federal courts located in Maricopa County, Arizona.
- If any part of this Agreement is found unenforceable, the rest remains in effect, and the unenforceable part will be enforced to the fullest extent permitted.
- This Agreement, together with the Refund & Cancellation Policy, Terms of Service, Client Privacy Notice and Privacy Policy, is the entire agreement between us about coaching. Changes must be in writing.
- You confirm that you are at least 18 years old.
- Couple plans: each adult signs this Agreement for themselves. One person signing does not sign for the other.
- Children: a child under 18 takes part only with the permission of a parent or legal guardian who signs this Agreement. You agree to this Agreement, including the Assumption of Risk and Release of Liability, on the child's behalf, to the extent the law allows, and you confirm you have the legal authority to do so. A parent or guardian will be present or close by during any in-person session with a child, and I will not meet with a child alone in private.
