Terms of Service

These Terms of Service ("Terms") govern your use of this website and any purchase of coaching or other services from Whole Body By Design, LLC ("Whole Body By Design," "we," "I," or "us"). By using the site or buying a service, you agree to these Terms. If you don't agree, please don't use the site.

1. Educational information only

Content on this website, in emails, newsletters, social media and the Client Library is for general education. It is not medical advice. I do not diagnose or treat disease. Always talk with your physician before changing your diet, exercise or supplements. See the Health Disclaimer.

2. Coaching services

Coaching clients must also sign the Coaching Agreement & Release at sign-up. If anything in these Terms conflicts with the Coaching Agreement, the Coaching Agreement controls for coaching services. You must be at least 18 years old to buy coaching.

3. Prices and payment

Prices are listed in US dollars and may change at any time, but a change will not affect a purchase you have already made. You can pay by Zelle, Venmo or cash in person. If card payments are added, they will be processed securely through Shopify, and I never see or store your full card number. Once your first 3 months of coaching end, monthly payments are due on the 1st of each month until you cancel as described in the Refund & Cancellation Policy.

4. Refunds and cancellations

Refunds and cancellations are governed by the Refund & Cancellation Policy.

5. Accounts and the Client Library

Client Library access is for active coaching clients only. Your account is personal: don't share your login or let anyone else use it. We may suspend access if an account is shared or misused. Access ends when your coaching ends.

6. Intellectual property

All content on this site and in the Client Library, including text, recipes, meal plans, exercise programs, photos, logos and designs, is owned by Whole Body By Design, LLC or used with permission, and is protected by copyright and trademark law. You may view and use it for your own personal, non-commercial use. You may not copy, reproduce, resell, publish or distribute it without written permission.

7. Your conduct

You agree not to use the site for anything unlawful, to interfere with its security or operation, to upload harmful code, or to scrape or copy content in bulk.

8. Third-party links and products

The site may link to other websites and stores. I don't control them and am not responsible for their content, products, policies or practices. Purchases from other stores are between you and that seller. Some links may be affiliate links, and I will say so when they are.

9. Disclaimer of warranties

The site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. I don't guarantee any specific health, fitness or weight result.

10. Limitation of liability

To the fullest extent permitted by law, Whole Body By Design, LLC and its owner, employees and contractors are not liable for any indirect, incidental, special or consequential damages arising from your use of the site or services. Our total liability for any claim will not exceed the amount you paid us in the three months before the claim arose.

11. Indemnity

You agree to hold Whole Body By Design, LLC harmless from claims arising out of your breach of these Terms or your misuse of the site or its content.

12. Governing law

These Terms are governed by the laws of the State of Arizona. Any dispute will be handled in the state or federal courts located in Maricopa County, Arizona.

13. Changes

I may update these Terms from time to time. The "last updated" date shows the latest version. Continuing to use the site after a change means you accept the updated Terms.
